Embodiment."19 This is problematic because the term "mode" does not equate precisely to the term "embodiment" as the former is broader than the latter. An embodiment is that in which an idea is concretely expressed.20 Thus, an embodiment is something concrete or tangible, which can be subject to several different modes of manufacture, operation, implementation, uses of materials, etc. Furthermore, the term "best" is somewhat less subjective than the term "preferred". In other words, it is possible for an inventor to recognize that one mode is best for the intended commercial goals of the invention, such as lowering the cost and increasing the performance of the inventive subject matter. At the same time, however, the inventor may nonetheless prefer a different mode of the invention in accordance with a personal goal, such as increasing the environmental friendliness of the inventive subject matter. Thus, the terms "best" and "preferred" may be in conflict in the context of patent law disclosure. Therefore, mutated phrases like "preferred mode" or "preferred embodiment" should not be confused with the statutory phrase "best mode, " especially since there is no explicit statutory requirement for a preferred embodiment or preferred mode. ii. Contrasted with the "Description" and "Enablement" Requirements The best mode requirement is distinct from the enablement requirement, which in turn is distinct from the description requirement.21 The description of an invention is presumptively adequate upon filing and involves a factual question of whether the inventor has provided a specification as of the date of filing her patent application ; that conveys with reasonable clarity, to those of ordinary skill in the art, that the applicant was in possession of her invention as finally claimed ; .22 In other words, the inventor must describe essentially "what" she has invented and may not, after filing her patent application, attempt to reorient the claims beyond what was originally supported in the specification. In essence then, the description requirement is a proscription on attempting to claim new matter not originally disclosed. In contrast, the enablement requirement presents a legal question of whether the specification discloses information sufficient to enable one.

The minimum-necessary requirement applicable to providers in the context of claims submission has been a source of considerable discussion within the industry. Health plans that are asked to approve and pay claims are entitled to ask for information they believe is needed to conduct their functions. Such plans are covered entities that have a specific obligation to apply the minimumnecessary standard before making a request for information, 31 and HHS specifically allows a provider to rely on the request of another covered entity. A pharmacy may, therefore, provide information required by health plans or their PBMs acting as business associates, without liability under the HIPAA privacy rule.32 Ultimately, the health plan determines what information is needed from providers to authorize payment and to conduct other aspects of their health care operations. Health Plans A second type of covered entity directly regulated under the HIPAA standards is the "health plan." A health plan is defined as "an individual or group plan that provides or pays the cost of medical care."33 The rule provides a nonexclusive list of the types of payers for health services covered by the rule, specifically including insurers, BlueCross BlueShield plans, health maintenance organizations, Medicare and Medicaid, and a number of other government programs. Employee welfare benefit plans are also health plans that are covered entities directly subject to HIPAA the employer who sponsors an ERISA plan is not a health plan subject to HIPAA, but its health plan is and must meet specific requirements prior to allowing the plan sponsor access to PHI ; . Since more than 90% of drug spend in America today is covered at least in part by a third party, there will generally be a health plan with HIPAA obligations involved in most pharmacy activities. As with providers, health plans, including insurers, health maintenance organizations, and ERISA plans, have direct responsibility to meet the HIPAA privacy requirements, providing to individuals the protections and rights under the HIPAA standards and having in place a privacy officer and other administrative requirements. Some requirements will be virtually impossible for many health plans to meet without assistance. For instance, the transaction standards require that the health plan accept claims from pharmacy providers in the "standard" format NCPDP 5.1 ; , but a plan typically does not contract directly with pharmacies or communicate with them directly. Rather, most health plans retain a PBM or other administrator to manage the network. The administrator would be a business associate of the health plan and may accept claims or submit payment advice in standard formats on the health plan's behalf. Health plans may use, disclose, or request PHI for treatment, payment, or health care operations, and may retain business associates to perform these functions. The activities involved in the administration of the drug benefit fall within these definitions. Health plans may use or disclose data for financial, actuarial, and clinical purposes. These functions may include analyses of uti and carbamazepine.

A few years ago most American consumers would have found the term "grassfed beef " unfamiliar and a little confusing. Don't most cows eat grass, after all? Yes, they do, at least until the last six months or so of their lives, when most cattle destined for American tables are put into giant feed lots. There the cows are fattened up on corn and other grains, which give their meat the marbled texture Americans have been taught is the sign of great beef. In the last few years books like "Fast Food Nation" and "The Omnivore's Dilemma" have filled Americans in about feedlots and giant lagoons of manure and other aspects of commercial beef production they were blissfully ignorant of in the past. That information, augmented by news of beef recalls and animal abuse in some slaughterhouses, has sent some consumers on a search for better beef. For a few, the search has ended at Sunnyslope Farm in Upper Makefield, where George and Claire Lankas raise steers on 30 acres of grassland. At first the couple raised the animals only for their own use, but after a while people began calling and asking to buy their beef. Little by little, they added a few more calves to the number they buy in the spring, so they'd have beef to sell by the quarter or half steer in the fall. George Lankas is con.

Mittee at the 53rd annual meeting of the SNM. The objectives of the paper are to review briefly the historical literature, to summarize key experiments, and to describe the current understanding of mechanisms thought to be involved in bystander and lowdose-rate LDR ; hypersensitivity effects. Radiation-induced bystander effects are biologic responses in cells that were not traversed by an ionizing radiation track and, thus, not subject to direct energy deposition; that is, the responses occur in nonirradiated cells. These bystander effects take place in the neighbors of irradiated cells or in other nonirradiated cells that have received secreted signals from irradiated cells. As such, bystander effects are somehow communicated from an irradiated cell to a nonirradiated bystander cell via cell-to-cell gap junctions 1 ; or by the secretion or shedding of soluble factors 2 ; . The precise nature of factors that mediate the bystander effect is unknown, but reactive oxygen and nitrogen species and various cytokines have been implicated 36 ; . Radiationinduced bystander effects have been extensively documented in several recent reviews 710 ; , which have described both detrimental e.g., DNA strand cleavage, chromosomal damage, and cytotoxicity 11 and potentially beneficial e.g., radioprotection 12 bystander effects. Although the bystander effect is widely considered a new concept, reports that biologic entities may be inactivated equally by ionizations within the entity or in the surrounding medium have existed since the 1940s 13 ; , and clastogenic factors in plasma from radiotherapy patients were first observed in the 1950s 14, 15 ; . The current high level of interest in bystander effects was sparked by Nagasawa and Little in 1992 16 ; . Using a very low fluence a-particle microbeam, they found that more cells had sister chromatid exchanges than were predicted by calculations of cell traversal probability. Since then, studies have demonstrated that bystander effects induced by high linear energy transfer LET ; --but not those induced by low LET--are dependent on cellular interaction and functioning gap junctions 13, 17 and trihexyphenidyl.

Alpha terpineol is a volatile oxygenated monoterpene, found in various animals and plants and plant juices consumed in daily life. In this study, activities on the experimentally induced convulsions were studied as one of the steps of our studies on alpha-terpineol. Albino mice of either sex were subject to 1, 10 and 100 mg kg i.p alpha-terpineol. Anticonvulsive actions were tested using pentylenetetrazol 80 mg kg ; induced convulsions. As a result, alpha-terpineol inhibited convulsive effects of pentylenetetrazol only at 100 mg kg but not at other tested doses, and to the best of our knowledge, this is the first report on the anticonvulsive effect of alpha-terpineol and naproxen. The baseline annual probability of death from prostate cancer for the watchful waiting strategy was taken from Bill-Axelson et al. 2005 ; . Standard regression techniques were used to estimate a Weibull function3 from the published 10-year Kaplan-Meier disease-specific survival curve Figure A3.2 ; . To this was added the annual probability of death from other causes, taken directly from the UK Government's Actuarial Department : gad.gov Life Tables eoltable ; . The annual probability of developing metastatic disease was also estimated from Bill-Axelson et al. 2005 ; by again fitting a Weibull function. However, as a consequence of using a two rather than three-state model, the probability of developing metastatic disease was assumed to be cumulative, and as such, represented at any single point in time, the proportion of patients who were in the health state `alive' but living with metastatic disease. Abstinence from other substances of abuse. It is important to focus not just on alcohol use but also to address other substances of abuse that pose the same level of concern and possible adverse consequences. The abuse of other substances can be evaluated by random urinalysis, collateral reports from family or employer with the patient's written consent ; , and self-reports from the patient. In addition to illicit substances, abuse of prescription and nonprescription medications is an important issue and should be addressed. In this regard, the patient's agreement or resistance to continuing treatment may indicate the level of willingness to consider the abuse of other substances as a problem. Normal eating conditions, any differences between fed and fasted bioavailability would be clinically insignificant. The reason for this, in part, is the half-life for a single 400 mg dose reported in King' labeling in the fasted state 9.2 hours ; is longer than the half-life in the fed s state 2.4 hours ; . Thus, fed patients will absorb, metabolize, and eliminate metaxalone more rapidly than; fasted patients, thereby leaving the fasted patients with more residual metaxalone in the body at the time the next dose is administered. As this pattern is repeated during the recommended dosing regimen, the difference between fed and fasted plasma concentration levels would diminish to insignificant levels over time. 43. In addition, the average American meal would be expected to contain and buy carbamazepine.
